Adtouch Labs, Inc. (“Adtouch Labs,” “we,” “us,” or “our”) provides a communications workflow automation platform that enables businesses to automate phone calls, messaging, and related customer communications (the “Service”).

This Privacy Policy explains how we collect, use, disclose, and protect information when:

  • A business customer (“Merchant,” “Customer”) uses the Service; or
  • An individual (“Caller”, “Recipient,” “Consumer”) interacts with a Merchant through the Service.

By accessing or using the Service, you agree to this Privacy Policy and our Terms of Service.

Roles and Responsibilities

Adtouch Labs Responsibilities

Adtouch Labs provides a communications workflow automation platform that enables Merchants to configure, automate, and manage customer communications across phone, messaging, and related channels.

In operating the Service, Adtouch Labs:

  • Provides the underlying software, infrastructure, and AI systems
  • Processes communications and related data in accordance with Merchant configurations and instructions
  • Maintains the availability, security, and performance of the platform
  • Does not independently determine what customer data is collected, requested, or communicated

Adtouch Labs does not own the Merchant's customer relationships and does not initiate communications with customers except as configured by the Merchant through the Service.

Merchant Responsibilities

Merchants control how the Service is used in their business operations. This includes decisions about:

  • Which communication workflows are enabled
  • What information is requested from customers
  • Which phone numbers, messaging channels, or automation rules are used
  • What data sources are connected (such as websites, documents, or reservation systems)
  • How outputs from the Service are reviewed, acted upon, or communicated to customers

Because Merchants control these decisions, Merchants are responsible for:

  • Providing appropriate notices to customers regarding automated communications, call handling, and messaging
  • Obtaining any required consent for communications, call recording, transcription, or data collection
  • Ensuring that information provided to the Service is accurate, current, and lawful to use
  • Complying with applicable privacy, telecommunications, consumer protection, and marketing laws

Adtouch Labs processes customer communications and related data solely to provide the Service and does so based on merchant instructions and configuration.

Customer Communications and Transparency

Merchants are responsible for determining how and when customers are informed that:

  • Calls may be answered or assisted by automated systems
  • Call audio may be recorded and transcribed
  • Messages may be sent automatically based on workflow rules
  • Information shared during communications may be summarized or structured for follow-up

Adtouch Labs provides the technical capability to support these workflows but does not control the content of customer disclosures or the business' compliance obligations.

Information We Collect

Information Collected from Merchants

We collect information from Merchants that subscribe to the Service, including:

  • Account Information: Business name, contact name, email address, phone number, billing details
  • Configuration Data: Call flows, routing rules, workflow logic, message templates, notification preferences
  • Website and Content Data: Website pages, FAQs, product descriptions, policies, and other content you authorize us to collect and format for use by the AI system
  • Integration Data: Identifiers, credentials, or access tokens required to connect third-party systems (e.g., reservation or booking platforms)
  • Support Communications: Messages or materials shared with our support team
  • Usage and Billing Data: Call volume, message volume, workflow execution, system logs

Payment and billing information is processed by third-party payment processors (such as Stripe or similar providers). Adtouch Labs does not store full credit card numbers or sensitive payment credentials. Payment processors handle this information in accordance with their own security and privacy practices.

Information Collected from Callers and Message Recipients

When an individual interacts with a Merchant via the Service, we may collect:

  • Caller Identifiers: Phone number and, if provided, name or email address
  • Interaction Content: Information voluntarily shared during calls or messages (e.g., booking requests, dates, party size)
  • Call Processing Data:
    • Call audio is processed to generate transcripts
    • Call transcripts are used to extract structured information, summaries, classifications, and workflow outputs
    • Call audio and transcripts may be stored for:
      • Troubleshooting and quality assurance
      • Legal and regulatory compliance
      • Security monitoring
      • Dispute resolution
      • Enforcement of our agreements

We do not control or determine the disclosures or consent mechanisms Merchants use with their callers.

Information from Third Parties

When Merchants connect third-party systems, we may receive data from:

  • Reservation, booking, or CRM platforms
  • Referral partners or resellers
  • Infrastructure providers supporting Service delivery

Merchants are responsible for ensuring they have the right to share this data.

Cookies and Dashboard Analytics

When Merchants access the Service dashboard or related web-based tools, we may use cookies and similar technologies for authentication, session management, analytics, and performance monitoring. These technologies help us operate, secure, and improve the service, including understanding feature usage and system performance. Merchants can manage cookie preferences through their browser settings.

How We Use Information

We use collected information for the following purposes:

To Operate the Service

  • Execute communication workflows
  • Route and forward calls and messages
  • Deliver booking links, notifications, confirmations, or updates
  • Generate and deliver structured outputs to Merchants
  • Maintain dashboards, logs, and reporting tools

Automated Processing and Analysis

  • Transcribe call audio
  • Generate summaries, classifications, and sentiment indicators
  • Extract structured information from communications
  • Enable automation of follow-up tasks and workflows

Automated outputs are probabilistic and not guaranteed to be accurate.

Support, Security, and Compliance

  • Diagnose technical issues
  • Monitor for abuse or misuse
  • Enforce our Terms of Service

Product Improvement (Aggregated / De-Identified)

  • Analyze aggregated usage patterns
  • Improve system performance, reliability, and automation capabilities
  • Train and evaluate internal models using anonymized or aggregated data

We do not sell personal data or use caller data for unrelated advertising purposes.

How We Share Information

With the Merchant You Contact

If you contact a business using the Service, we share with that business:

  • Your phone number
  • Any contact details you provide
  • Inquiry details
  • AI-generated summaries and classifications
  • Relevant metadata (time, duration, routing)

With Service Providers

We use third-party providers to deliver the Service, including:

  • Telephony and messaging providers
  • Cloud infrastructure providers
  • Email providers
  • Analytics and logging tools
  • AI processing providers

These providers process data solely to support the Service and are contractually restricted from using data for their own purposes.

With Integration Partners

When authorized by a Merchant, we share data with connected platforms (e.g., booking systems) as required to execute workflows.

Legal and Business Events

We may disclose information:

  • To comply with legal obligations
  • To protect rights, safety, or property
  • In connection with a merger, acquisition, or asset sale

Messaging, Opt-In, and Opt-Out

Messaging features rely on carrier-supported mechanisms, including standard opt-out keywords (e.g., “STOP”).

Merchants are responsible for:

  • Ensuring proper opt-in
  • Honoring opt-out requests
  • Complying with carrier and regulatory rules

We process opt-out requests using our messaging providers' tools when applicable.

Data Security

We implement reasonable administrative, technical, and organizational safeguards to protect data from unauthorized access, loss, or misuse.

No system is completely secure, and we cannot guarantee absolute security.

Data Retention

Merchant Data

  • Account and billing data is retained while the account is active and for a reasonable period thereafter
  • Configuration and usage data may be retained for operational and compliance purposes

Caller Data

  • Call audio and transcripts may be retained for troubleshooting, legal compliance, dispute resolution, and enforcement
  • Structured outputs, summaries, and metadata may be retained to support reporting and workflow execution
  • Retention periods may vary based on legal, operational, or contractual requirements

International Data Processing

The Service is operated using infrastructure and service providers that may process and store data in the United States and other jurisdictions where Adtouch Labs or its service providers operate. By using the Service, merchants acknowledge that information may be transferred to and processed in locations outside the Merchant's or caller's jurisdiction, subject to appropriate safeguards.

Requests from Callers Regarding Personal Data

Requests from callers or message recipients regarding access, correction, deletion, or other rights related to their personal data should be directed to the merchant with whom they interacted. Adtouch Labs supports Merchants in fulfilling such requests where required by law and technically feasible, consistent with the Merchant's instructions and applicable agreements.

Children's Information

The Service is intended for business use and adult callers. We do not knowingly collect personal data from children.

Changes to This Policy

We may update this Privacy Policy from time to time. Updates will be posted with a revised effective date. Continued use of the Service constitutes acceptance.
